EastEnders spoilers: Phil Mitchell hit with ultimate betrayal as Ben gets dark revenge
The residents of EastEnders were utterly shocked to see Phil Mitchell (played by Steve McFadden) rock up on the day of Dennis Mitchell’s (Bleu Landau) funeral. But, Sharon Mitchell (Letitia Dean) is not going to be the only person wanting revenge, as there is a chance Phil’s son, Ben Mitchell (Max Bowden) is gunning for justice following the injury he sustained the night of the Thames boat accident which has subsequently lost him his hearing.
Express.co.uk spoke exclusively to Ipek Tugcu, an Associate Solicitor at Bolt Burdon Kemp about the legal steps Ben could take in terms of his hearing.
In scenes which aired last night, Ben’s frustrations at being unable to hear were made clear.
“You just need to speak a bit clearer,” Callum Highway (Tony Clay) told Suki Panesar (Balvinder Sopal) who came to pay her respects to the mechanic.
“Callum!” Ben snapped, but his boyfriend continued: “He’s just a little bit hard of hearing.”
“Deaf? Are you deaf?” Suki remarked before turning to Callum and continuing her conversation. “Just tell your friend how sorry I am.”

“You can tell him yourself but you just need to speak clearly,” Callum said and Suki pronounced each word she said excessively: “Our condolences. Your family is in our prayers.”
“I don’t need your help,” Ben stated to Callum. “Am I not allowed to just be sad for Dennis? I’m not just the poor disabled bloke you know. You going to save me again are you Callum? Get over yourself.”
Ben lashing out at those closest to him is normal, Ipek explained how his “relationships with his loved ones is bound to be affected by his hearing loss”.
“Losing the ability to hear means we lose our primary way of communicating.
“It can lead to relationships breaking down and brain injury survivors isolating themselves,” she added.
“It’s so important for those around him, including his daughter and partner, to understand how much this is going to impact Ben and try to be there for him.”
“Depending on the extent of Ben’s hearing loss, his family may need to find alternative ways to converse with him. This may include having to learn sign language, but also being patient and understanding when Ben feels angry, frustrated and low about these changes in his life,” Ipek added.
As for the legal course Ben could take to try and get compensation for the loss of his hearing, Ipek he would need to find out who was responsible for the boat accident.

“Ben would be eligible to bring a legal claim for compensation if he has evidence to show that he suffered his brain injury, and the subsequent hearing loss, as a result of someone’s unacceptable failing,” Ipek explained.
“Ben was injured in a boat crash, so to know whether he can take legal action – we’d first have to look at why the boat crashed and whether this was someone’s fault.
“If there was enough evidence to prove that the boat crashed because of unacceptable failings, Ben would be entitled to compensation for all the injuries and financial losses he suffered because for the accident.
“This would include loss of earnings and compensation to cover medical and travel needs,” the legal expert added.

Does this mean Ben is going to go after his father for temporarily destroying his life, as well as possibly his career and relationship with Callum?
As for whether it is possible for Ben to regain any of his hearing, or even making a full recovery, Ipek couldn’t give a definite answer.
“Hearing loss can sometimes be recovered or improved after a brain injury, depending on what has caused the hearing loss and whether there’s treatment or equipment to help with this,” she said.
